Paul O’Dwyer is an established immigration attorney, with over twenty-five years’ experience with all aspects of immigration law. With Malecki Law’s Securities Employment Lawyers, including Jenice L. Malecki, he represents non-citizen employees in the US whose visas have been sponsored by their securities employers, as well as other non-citizens who are the subject of an investigation by the U.S. Securities Exchange Commission or other regulator.

In such situations, Mr. O’Dwyer is able to provide immigration advice to a client independent from the employer’s immigration attorney that the employee used for its applications. This is advice that is in the client’s best interest and without a conflict between the employee and employer. Further, if an employee is terminated or transitioning to a new situation, the employing company’s lawyers will no longer be able to help the sponsored employee, because they represent the company, not the employee. It is critically important to have someone on your side available to answer your questions, as well as be available to assist you with your immigration application.

Mr. O’Dwyer is also available to assist Malecki Law’s SEC Subpoena attorneys in situations where a non-citizen receives a subpoena or notice of investigation from any government actor. Deciding whether to participate in such an investigation or else plead the Fifth Amendment in this situation needs to be assessed and addressed by both a securities lawyer and an immigration lawyer, who can properly advise on the impact your decisions can have on your immigration status

A graduate of the National University of Ireland and the Honorable Society of Kings’ Inns, Dublin, Mr. O’Dwyer was admitted in 1990 to practice law in New York State. He also has been admitted to numerous Federal Courts of Appeals and District Courts in the United States as well as the US Supreme Court He represents non-citizens in all areas of immigration law, including asylum, deportation/removal defense, appeals and federal litigation. He has successfully represented many individuals facing deportation, or being denied green card or citizenship, because of criminal and terrorism-related accusations. He has also represented many individuals and companies on employment-based green card applications, in addition to H-1, E-1 and O-1 petitions, and self-petitions for individuals of extraordinary ability and “national interest waiver” applications.

Mr. O’Dwyer regularly writes articles and speaks on immigration law panels and in seminars frequently, for groups such as the American Immigration Lawyers Association, the Federal Bar Association, and the Practicing Law Institute, and has written and spoken extensively on overcoming criminal-related obstacles to obtaining and/or preserving immigration status and waivers of inadmissibility. Mr. O’Dwyer has been recognized by his peers as an expert in the field, and was for a period was Special Counsel on Immigration to the Attorney Grievance Committee of the First Judicial Department in New York. Mr. O’Dwyer has been a member and chair of numerous committees within the American Immigration Lawyers Association. He further was an active member of the New York City Bar Association Committee on Immigration and Nationality Law, and was a founding board member of the Association of Deportation Defense Attorneys.

Mr. O’Dwyer has been consistently voted as a “SuperLawyer” (a division of Thompson Reuters) and has been recognized as a “top immigration lawyer” in the New York metropolitan area.
